Eagle County has adopted a replacement land-use code, but it does not take effect immediately. The county’s published regulations say the Board of County Commissioners adopted the code on November 3, 2026, with an effective date of June 1, 2027. If you own land or are planning a project in unincorporated Eagle County, the first useful step is to check which jurisdiction and zoning rules apply to your parcel.

Does the new county code apply inside a town?

The county’s land-use regulations govern land in unincorporated Eagle County. Properties within incorporated towns such as Vail, Avon, Eagle, Gypsum, Minturn, Red Cliff and Basalt follow their municipal land-use rules. A mailing address alone may not tell you which jurisdiction handles a permit. Confirm your parcel and jurisdiction with Eagle County Community Development at 500 Broadway in Eagle or the relevant town before relying on a code section.

What changed, and when?

The rewrite covers zoning districts and the official map, subdivisions, planned unit developments and other development standards. The county’s project page describes the effort as a way to simplify language, resolve inconsistent provisions and respond to state law and county policy. The published code is the place to check the adopted wording; earlier discussion drafts and public comments may differ from the final text.

The June 1, 2027 start date matters for anyone considering a subdivision, a new home, an accessory dwelling unit or a change of use. It does not mean every existing structure must be rebuilt. Existing approvals and applications may have transition rules, and a property’s zoning, water, wastewater, access and hazard constraints still matter. Ask county staff how the transition provisions apply to your specific project before spending money on plans.

How can I check my property?

  1. Confirm whether the parcel is in unincorporated Eagle County or an incorporated town.
  2. Use the adopted code and zoning information to find the applicable district and use standards.
  3. Note any existing planned unit development approval, easement or site-specific restriction.
  4. Contact Eagle County Community Development with the parcel number and a short description of the proposed work. Ask which rules and application dates apply.
